Kimileri taraf\u0131ndan mutlak bir \u015fekilde idealle\u015ftirilip kimilerince de \u201c\u00f6yle olmad\u0131\u011f\u0131\u201d iddias\u0131 ile ele\u015ftirilirken, y\u0131llar boyunca g\u00fcncel, ekonomik, politik, felsefi ve benzeri anlamda bir\u00e7ok tart\u0131\u015fmaya konu olmu\u015ftur ve hala olmaya devam etmektedir.<\/p>\n<p>Evrensel kabul g\u00f6rm\u00fc\u015f tek bir tan\u0131m\u0131 olmayan bu s\u00f6z ile ilgili genele yay\u0131lm\u0131\u015f fikir; insanlar\u0131n ya\u015fad\u0131klar\u0131 \u00fclkenin, topraklar\u0131n, vatan\u0131n ya da devletin, o insanlar\u0131n m\u00fclk\u00fc oldu\u011fu ve bu m\u00fclk\u00fcn yani k\u0131saca devletin temelinin ise adalete dayand\u0131\u011f\u0131 y\u00f6n\u00fcndedir. Bu yayg\u0131n fikir, devletin temeli olarak kabul edilen adalet sayesinde devleti olu\u015fturan toplumdaki bireylerin e\u015fitlik ilkesi ile temsil edildi\u011fini ortaya koyarken, bir manevi ihtiya\u00e7 olarak da tan\u0131mlanan adaletin olmad\u0131\u011f\u0131 \u00fclkelerde huzur, refah ve sayg\u0131 ortam\u0131n\u0131n olamayaca\u011f\u0131, toplumda karga\u015fa, huzursuzluk ve kaos ortam\u0131n\u0131n artaca\u011f\u0131 ve bu sebeplerle bireylerin devlete olan g\u00fcvenlerinin yok olmaya do\u011fru gidece\u011fi anlay\u0131\u015f\u0131 ile de desteklenmektedir. Bu ba\u011flamda, \u201cAdalet M\u00fclk\u00fcn Temelidir\u201d s\u00f6z\u00fcndeki m\u00fclk kavram\u0131n\u0131n insana, \u00fclkeye, e\u015fitli\u011fe ve varl\u0131\u011fa dair oldu\u011fu anlamlar\u0131n\u0131 \u00e7\u0131karmak san\u0131r\u0131m yanl\u0131\u015f olmayacakt\u0131r.<\/p>\n<p>Yukar\u0131daki yakla\u015f\u0131mlarda da g\u00f6r\u00fclece\u011fi ve anla\u015f\u0131laca\u011f\u0131 \u00fczere adalet kavram\u0131 manevi ve soyut bir kavramd\u0131r. Adaleti sa\u011flayacak toplumsal ya\u015fama d\u00fczenlerine dair herhangi bir somutlu\u011fu i\u015faret etmezken, tabiri caizse her t\u00fcrl\u00fc fikirce alt\u0131 doldurulmaya m\u00fcsait bir \u201cgizemlili\u011fe\u201d sahiptir. Bunun sebebiyse ku\u015fkusuz hak, hukuk, e\u015fitlik vb. kavramlar gibi adalet(sizlik) kavram\u0131n\u0131n da evrensel bir tan\u0131ma oturtulamayacak kadar her topluma ait ekonomik ili\u015fkilerce belirlenen ve bu ili\u015fkiler de\u011fi\u015ftik\u00e7e de\u011fi\u015fen bir kendine hasl\u0131\u011f\u0131n\u0131n olmas\u0131d\u0131r. Bu y\u00f6n\u00fc ile hem de\u011fi\u015fken hem de tarihseldir. K\u0131sacas\u0131 adalet, her durumda tarihle ve zamanla s\u0131n\u0131rl\u0131 olup evrensel bir adalet anlay\u0131\u015f\u0131ndan s\u00f6z edebilmek m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Modern s\u0131n\u0131fl\u0131 toplumlar\u0131n ortaya \u00e7\u0131kmas\u0131 ile birlikte m\u00fclk\u00fcn yani varl\u0131\u011f\u0131 olu\u015fturan \u015feyin temeli olan adaleti sa\u011flamak devletlerin g\u00f6revi olmu\u015ftur. Adaletin terazisinin bozulmamas\u0131, bozulan terazinin ise dengelenmesi bir m\u00fcdahale g\u00fcc\u00fcn\u00fc gerektirece\u011finden, bu g\u00fcc\u00fc tekelinde bulunduran da yine devletler olacakt\u0131r. Bug\u00fcn i\u00e7inde ya\u015fad\u0131\u011f\u0131m\u0131z d\u00fcnyan\u0131n adalet anlay\u0131\u015f\u0131 hi\u00e7 ku\u015fku yoktur ki neoliberal kapitalist sistemin adalet anlay\u0131\u015f\u0131d\u0131r.<\/p>\n<p><b>Peki, kapitalizmin terazisi dengeli mi?<\/b><\/p>\n<p>Kapitalist sistem; adaletin, m\u00fclk\u00fcn yani varl\u0131\u011f\u0131n temeli oldu\u011funu, herkesin yasalar \u00f6n\u00fcnde e\u015fit oldu\u011funu ve ki\u015filer aras\u0131nda f\u0131rsat e\u015fitli\u011finin bulundu\u011funu iddia ederken Marx, kapitalizmi s\u00f6m\u00fcr\u00fcc\u00fc bir d\u00fczen olarak tan\u0131mlar ve h\u0131rs\u0131zl\u0131kla su\u00e7lar. Bunun yan\u0131nda yine Marx, tarihsel materyalist ba\u011flamda alt yap\u0131-\u00fcst yap\u0131 ili\u015fkilerindeki s\u00fcreklili\u011fe, alt yap\u0131n\u0131n \u00fcst yap\u0131y\u0131 belirlerken \u00fcst yap\u0131n\u0131n alt yap\u0131y\u0131 etkiledi\u011fine, bu diyalektik ili\u015fkinin son kertesinde ise \u00fcst yap\u0131n\u0131n alt yap\u0131y\u0131 me\u015frula\u015ft\u0131rd\u0131\u011f\u0131na vurgu yapar. Somutla\u015ft\u0131rmak gerekirse, her \u00fcretim bi\u00e7iminin (alt yap\u0131) kendine \u00f6zg\u00fc bir adalet tarz\u0131 (\u00fcst yap\u0131) ve payla\u015f\u0131m sistemi vard\u0131r; dolay\u0131s\u0131 ile \u00fcretim bi\u00e7imlerinden ba\u011f\u0131ms\u0131z bir adalet anlay\u0131\u015f\u0131 da m\u00fcmk\u00fcn olamayacakt\u0131r. Kapitalist \u00fcretim bi\u00e7iminin etkilerine bakt\u0131\u011f\u0131m\u0131z zaman, \u00f6zellikle de kapitalizmin neoliberal d\u00f6nemi politikalar\u0131 ile halk nezdinde ciddi bir m\u00fclks\u00fczle\u015ftirme ya\u015fand\u0131\u011f\u0131n\u0131, di\u011fer yandan az\u0131nl\u0131k olarak ekonomik g\u00fcc\u00fcn\u00fc daha da art\u0131ran sermaye kesimi ile halk y\u0131\u011f\u0131nlar\u0131 aras\u0131ndaki bu u\u00e7urumun g\u00fcnden g\u00fcne b\u00fcy\u00fcmekte oldu\u011funu g\u00f6r\u00fcr\u00fcz. Tarihsel ilerleme a\u00e7\u0131s\u0131ndan bak\u0131ld\u0131\u011f\u0131nda e\u015fitlik, adalet ve \u00f6zg\u00fcrl\u00fck kavramlar\u0131 feodal d\u00f6neme nazaran daha ileri bir d\u00fczeyde olan kapitalizm, bug\u00fcn geldi\u011fi noktada \u00fcretim ili\u015fkileri ile \u00fcst yap\u0131y\u0131 belirlerken, devletlerin y\u00fcr\u00fcrl\u00fc\u011fe koydu\u011fu sermaye yarar\u0131na yasalar\u0131yla da \u00fcretim ili\u015fkilerini yeniden etkilemekte ve kendini me\u015frula\u015ft\u0131rmaktad\u0131r. Her \u015feyin paraya endeksli oldu\u011fu, halk\u0131n giderek m\u00fclks\u00fczle\u015ftirildi\u011fi, yasalar\u0131n sermaye yarar\u0131na ve onu koruyan bir mant\u0131kla yap\u0131ld\u0131\u011f\u0131, adalete ula\u015fmada her isteyenin yarg\u0131dan kolayca yararlanamad\u0131\u011f\u0131, sermaye ile halk aras\u0131ndaki s\u0131n\u0131fsal ve ekonomik \u00e7eli\u015fkilerin giderek daha da derinle\u015fti\u011fi ko\u015fullarda, herkesin yasa \u00f6n\u00fcnde e\u015fit olmas\u0131n\u0131n ne adil bir kar\u015f\u0131l\u0131\u011f\u0131 ne de kapitalizmin adalet m\u00fclk\u00fcn temelidir iddias\u0131n\u0131n bir ger\u00e7ekli\u011fi olacakt\u0131r. Ekonomik a\u00e7\u0131dan e\u015fit olmayanlar\u0131n yasa \u00f6n\u00fcnde e\u015fit olu\u015funu ger\u00e7ek e\u015fitlik olarak kabul etmek ise zaten en b\u00fcy\u00fck e\u015fitsizlik ve adaletsizliktir.<\/p>\n<p><b>Adil bir d\u00fcnya m\u00fcmk\u00fcn m\u00fc?<\/b><\/p>\n<p>Adil bir d\u00fcnya d\u00fczeni hala arzulanan, yarat\u0131lmas\u0131 i\u00e7inse u\u011fruna m\u00fccadele verilmesi gereken bir olgudur. Daha adil, daha ya\u015fan\u0131l\u0131r bir d\u00fcnya i\u00e7in kapitalizmin s\u00f6m\u00fcr\u00fc d\u00fczenine, bu d\u00fczenin yaratt\u0131\u011f\u0131 ve g\u00fcnden g\u00fcne artan y\u0131k\u0131mlar\u0131na kar\u015f\u0131 Marksizm temelinde, sosyalist bir m\u00fccadele y\u00fcr\u00fctmek ve nihayetinde kapitalist sistemi ortadan kald\u0131rmak gerekmektedir. Her ne kadar yarat\u0131lacak sosyalist d\u00fczen daha adil ve daha ya\u015fan\u0131l\u0131r olacaksa bile, bununla da yetinilmemelidir. Zira adalet kavram\u0131n\u0131 d\u00fc\u015f\u00fcnmemize yol a\u00e7an \u015fey ise son tahlilde ekonomik e\u015fitsizli\u011fin ezilenler \u00fczerinde yaratt\u0131\u011f\u0131 yoksulluktur.
