Haks\u0131zl\u0131\u011fa u\u011frat\u0131lmay\u0131 da kabul etmem, hakk\u0131m\u0131 arar\u0131m.\u201d Ve ard\u0131ndan bir soru daha sorsak: \u201cPeki sizce adil bir toplumda m\u0131 ya\u015f\u0131yoruz?\u201d diye\u2026 Yine hemen herkes benzer cevaplar\u0131 verecektir: \u201cHay\u0131r, maalesef toplumumuz herkese adil davranm\u0131yor.\u201d Peki nas\u0131l oluyor da herkesin kendini adalet timsali g\u00f6rd\u00fc\u011f\u00fc bu sistemde toplumsal adaletten s\u00f6z edemiyoruz? \u0130\u015fte tam da bu y\u00fczden; sistem y\u00fcz\u00fcnden. \u00c7\u00fcnk\u00fc adalet sadece bireysel de\u011fil toplumsal bir olgudur. \u0130nsanlar\u0131n kendi hayatlar\u0131n\u0131 sadece kendi istemleri do\u011frultusunda var olacak bir adalet anlay\u0131\u015f\u0131nda ya\u015famalar\u0131 da adil bir topluma ula\u015fman\u0131n \u00f6n\u00fcndeki en b\u00fcy\u00fck engeldir. Ve bunun yani insanlar\u0131n \u00f6nce ve hatta bazen sadece kendi haklar\u0131n\u0131 g\u00f6zetmelerinin sebebi de, i\u00e7inde ya\u015fad\u0131\u011f\u0131m\u0131z ya da ya\u015famaya \u00e7al\u0131\u015ft\u0131\u011f\u0131m\u0131z, birilerinin di\u011ferinin \u00fczerine basarak hayatta kalabildi\u011fi sistemdir.<\/p>\n<p><b>Adalet nedir?<\/b><\/p>\n<p>Adalet, bir toplumda birey haklar\u0131n\u0131 sa\u011flama istemi, hakk\u0131n egemen olmas\u0131 durumudur. \u00c7a\u011flar boyunca filozoflar\u0131n adalet hakk\u0131nda \u00e7e\u015fitli g\u00f6r\u00fc\u015fleri olmu\u015ftur. Kimine g\u00f6re adaletin \u00f6z\u00fcnde bireyin kendini koruma i\u00e7g\u00fcd\u00fcs\u00fc bulunurken, kimine g\u00f6re adalet dostluktan beslenir. Kimine g\u00f6re adalet, adaletsizlikten korkuldu\u011fu i\u00e7in u\u011fruna m\u00fccadele edilen bir ama\u00e7t\u0131r. Adalet i\u00e7in g\u00fc\u00e7 gerekti\u011fini d\u00fc\u015f\u00fcnen filozoflara g\u00f6re de, g\u00fc\u00e7s\u00fcz iktidar adaletsiz, adaletsiz g\u00fc\u00e7 zorbad\u0131r. Adaleti a\u00e7\u0131klamaya \u00e7al\u0131\u015f\u0131rken ortakla\u015f\u0131lan e\u015fitlik ve \u00f6zg\u00fcrl\u00fck kavramlar\u0131, zamanlara, durumlara ve ki\u015filere g\u00f6re de\u011fi\u015fti\u011fi i\u00e7in de herkes adalet olgusunun alt\u0131n\u0131 farkl\u0131 bi\u00e7imlerde doldurmu\u015ftur.<\/p>\n<p><b>Bizce adalet nedir?<\/b><\/p>\n<p>Toplumu olu\u015fturan her bir birey olarak haklar\u0131m\u0131z\u0131n pe\u015fine d\u00fc\u015fmemiz gayet do\u011fald\u0131r. Ancak kabul etmek gerekir ki, kendi haklar\u0131n\u0131 arayan insanlar\u0131n bir\u00e7o\u011fu, o hakk\u0131 elde ederken geriye kalan insanlar\u0131n haklar\u0131na ne oldu\u011funu pek de fazla umursamay\u0131p gemisini kurtaran kaptan olmay\u0131 se\u00e7mektedir. Oysa ki\u015filerin her zaman ve sadece kendi haklar\u0131n\u0131 aray\u0131p, temas ettikleri ki\u015filerle olan ili\u015fkilerinde adalet sa\u011flamakla yetinmesi, toplumun geri kalan\u0131n\u0131 daha da b\u00fcy\u00fck bir karma\u015faya itmektedir. Adalet, herkes i\u00e7in ula\u015f\u0131labilirse, birisi hakk\u0131n\u0131 elde ederken \u00f6teki ezilmiyorsa ancak adalettir. Hak vermek, ezen i\u00e7in l\u00fctuf, hakk\u0131 elde etmek de ezilen i\u00e7in ba\u015far\u0131 ise bu hi\u00e7 de adil bir durum de\u011fildir. \u0130\u015f bulamayan\u0131n k\u00f6t\u00fc ko\u015fullarda \u00e7al\u0131\u015fmak zorunda kalmas\u0131 ve \u00fcst\u00fcne \u00fcstl\u00fck ge\u00e7inecek maddi yeterlili\u011fe de ula\u015famamas\u0131 ama bunun yan\u0131nda topluma hi\u00e7bir faydas\u0131 olmayan ki\u015filerin para i\u00e7inde y\u00fczercesine refaha ula\u015fmas\u0131 s\u0131n\u0131fsal adaletsizli\u011fin en b\u00fcy\u00fck g\u00f6stergesidir. Adil toplumda \u00f6yle bir sistem yarat\u0131lmal\u0131d\u0131r ki, a\u011f\u0131r i\u015f y\u00fck\u00fcn\u00fcn alt\u0131na giren i\u015f\u00e7iler evine ekmek g\u00f6t\u00fcr\u00fcp g\u00f6t\u00fcremeyece\u011fini, \u00e7ocu\u011funun okul masraflar\u0131n\u0131 nas\u0131l kar\u015f\u0131layabilece\u011fini kara kara d\u00fc\u015f\u00fcnmek zorunda kalmadan, o y\u00fck\u00fcn alt\u0131ndan keyifle kalkabilmelidir ve bu i\u015f y\u00fck\u00fc toplumun her kesimince payla\u015f\u0131labilmelidir. Sendikal\u0131 \u00e7al\u0131\u015fanlar haklar\u0131n\u0131 arama m\u00fccadelesinde sesini y\u00fckseltip sokaklar\u0131 doldururken, sendikas\u0131z i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rman\u0131n da yasak olmas\u0131n\u0131 savunmal\u0131 ve bunun i\u00e7in gerekeni yapmal\u0131d\u0131r. Mahkemelerde yarg\u0131lanan hi\u00e7bir kimse, kar\u015f\u0131s\u0131ndakinin sermayesi alt\u0131nda ezilmemelidir. \u015eiddet uygulayan ki\u015fi bilmelidir ki, esas g\u00fc\u00e7 \u00f6zg\u00fcrce ya\u015fama hakk\u0131n\u0131 savunmakt\u0131r ve adalet insanlar\u0131n birbirine zarar vermeden ya\u015famas\u0131 i\u00e7in vard\u0131r.<\/p>\n<p><b>Bir de Themis var ki herkes i\u00e7in anlam\u0131 ba\u015fka. Adaletin g\u00fcc\u00fcn\u00fc sadece paras\u0131 olanlar kullanabiliyor. Kitaplarda yazan yasalara ula\u015fmak olabildi\u011fince zor, zaten bu kitaplar\u0131n pek \u00e7o\u011fu da ezilenin de\u011fil ezenin kurallar\u0131n\u0131 yaz\u0131yor. Adalet, ayn\u0131 evi, ayn\u0131 yolu, ayn\u0131 soka\u011f\u0131, ayn\u0131 park\u0131 kullananlar\u0131n birbirinin fark\u0131nda olmas\u0131 ve iyi k\u00f6t\u00fc her \u015feyi adil payla\u015fmas\u0131d\u0131r.
